The Answer

Uber has several different insurance policies, depending on whether the driver was “on the app” and whether the Uber driver was at fault for the accident. If the Uber driver is at fault, Uber's $1 million insurance policy kicks in, and Uber corporate can also be held directly liable with strategic lawyering that shows the Uber driver was operating under the control of Uber. If the Uber driver did nothing wrong at all, then Uber's $200,000 UIM policy kicks in to protect both the Uber driver and the Uber passengers. Uber drivers and Uber riders who are injured in a rideshare accident can tap into this $200,000 UIM policy on top of their own personal UIM insurance policies.
